That depends on how long between the job being completed, and when they could actually go to look? You can't expect to not pay your bill just because you can't go to see it done. Payment on completion means just that

I do believe that you have to give them the opportunity to put things right.

If they do that and it is still a mess then you would need to work out if it makes financial sense to persue it.

You would have to weigh up the cost of a expert report against the amount of monies that you have paid as it’s about not chasing after monies that would cost you more in the long term.

An expert would also be able to let you know how much it would cost to put it right.

The next step would be weighing up all information given and then decide if or not to take it to a small claims court. I do believe the current amount claimable in a small claims court to be £10K.

Also, bear in mind that if you were to be successful in the small claims court that the courts themselves have no authority in ensuring that you are paid out so in essence it is then up to you to chase the plasterer (should you so wish) through the correct channels to enforce payment which then turns out into another ballache.

I took one to a small claims court and another took me to the small claims court and thankfully I came out on top on both times. I was taken to a small claims court by a builder who built a canopy for me, i got a expert report done on it at a cost of £250.00 that was scathing of it. The builder in question then refused to go along with the sitting judge’s recommendation of having another report done on it. The builder having stopped his claim for money faced no consequences. I asked the judge ‘what happens now because surely there has to be consequences because if not then that means the ball is always in the court of the claimant. I was told that i could seek for my lost expenses (£250.00, plus travel expenses to and fro from court) and even if succesful they cannot impose any authority for him to pay any award made to me as i would then have to seek another alternative to ensure he pays up.

You should really give them a chance to remedy it and I think you may possibly need to go down that route as a first course of action.
If they can’t do it to a satisfactory standard after then you have every chance of getting paid in full if it needs to go to court.
If he’s mentally not well then ask him if he can organise an alternative spread to do the works as he probably will know a couple.

Plumber by trade. Recently had whole house plastered, they did the upstairs and downstairs two weeks apart, paid materials upfront, half the bill when the upstairs was done and remaining when downstairs was done and they required payment on completion. Neither of us could get there to see the house until this weekend just gone, and the finish is very poor, mess everywhere, all the bottom of the walls are bowed out from their trowelling, just apprentice level plastering and no pride of the job.
The guy hasn't done a runner as such but he's mentally not very well which I believe is true so getting him to come back won't be achievable anytime soon! And honestly don't want him back. Where do I stand with this? I'm going to need to get another plasterer in to basically redo a lot of it and we can't afford to do that really without them giving us money back, they've said they will pay for it to be remedied but I'm worried it's going cost more than they think and then they might do a runner and we'll be really stuck. What's the best way of gettingy money back and it redone?
