My nearing neighbour has a tree in the back of their yard which is approximately 25ft tall and a span on it that goes over into my property and around 3 other neighbouring properties too.
I've put up with it for years with leaves and berries absolutely covering my yard and to the extent down into my drainage channels.
Ive been concerned regards this as I didn't know if the berries are poisonous ever since my granddaughter was born a few weeks ago and the possibility of her putting them in her mouth and swallowing them.
Strangely enough I saw one of the neighbours and she was saying that her puppy has been really poorly and it transpires that having taken her the vet it's these berries that have caused her sickness and diarrhea ‘fortunately my dog doesn't eat them'.
Any legal advice as to what my options are please and could I request that the tree is taken down or for them to keep pruning their branches so that I do not keep getting the mess?.

You can legally prune branches up to the border yourself. But you have to offer them back. Amazingly. I'm afraid they are under no obligation to do anything . If particularly aggrieved you can ask the council to look into the situation but they often charge a fee. I remember this from lookin into the woodland liability that we back on to.

There are plenty of articles online regarding this mate.Have you tried having a friendly chat with the neighbour who's garden it is in.You could express your concern that in a storm the tree could damage your property which potentially they would be liable for.I would cut the branches and put them back in their garden along with any berries/leaves that come off.Take pictures when you do incase they try to say you have damaged some of their property

Hi mate. Cheers for this. I never really realised whose garden it was actually in until the lady told me today that the berries off it had made her dog poorly ‘she thought it was from a different garden than from whose it actually is'. Just so happens that when I looked afterwards it is in the couples yard with whom I had words with ‘well, she with me actually' over a plug in pressure washer I was using in the summer to clean my yard. She telephoned the police over my use of the pressure washer and I had a visit from a local community officer. Oh my life she had a total meltdown at me and didn't like it when I gave her a few home truths back ‘nothing personal though'.
Anyway, cut a long story short she got personal stating my family ‘assume she meant my daughter that she knows has a brain tumour are a drain on the NHS and that I ‘well I did laugh' was a mong and proceeded to tell me that I don't work. Told her I'd worked all my life and then I was told by her ‘you haven't worked for years'. Told her I don't claim benefits so what's your problem?, wouldn't answer me.
I'd take great pleasure in any legal proceedings that I could take but unfortunately this would seem like not an option.
I can't get to the tree as it's in such a difficult to reach place ‘climb over 2 fences' and even if I did manage get to it there's a high risk of injury as those branches are just too high.
Edit - If I could get to it and without being seen I'd poison the 3100dy thing so that it killed it off.

OK had something like this,only in the wind,the branches kept whacking the 'launders'..guttering,and damaging them..
So,despite my neighbour being a good chap and saying he'd sort it,he didn't.. so..
I have a wonderful thing,it's a stihl pole pruner 18ft long, in the last storm I angle cut the branch,not all the way through,and oh dear it snapped off,deary me,what a shame
Problem solved
BTW,I work as a groundsman,gardner,picked up a few tricks over time..
Ps Glyphosate, in the roots,long pole,game over..lol

Walk into her garden with a chainsaw, cut the **** down and tell her if she comes too close you'll cut the sour old ****'s tits off.

Unfortunately she's a woman that has stated to me that they now have everything they need including their own home. She even told me that they've got the plasterers in and that's the last thing that would ever need doing and then went onto say that the kitchen will never need replacing because it is state of the art.
