Do you worry about your fridge or freezer catching fire in your house ?
When was the last time you had them serviced?

Everything carries an inherent risk
Go speak to the neighbour and let them know what your concerns are
Then go and get an independent report from a suitably qualified contractor if you are still worried
Most of the time just talking will work.

Personally I'd be more bothered about the noise

The maintenance of it is nothing to do with you, there may be a Building Control guidance on such things but more to do with noise than anything else as mentioned below.

Would you kick off if they had a BBQ next to the fence? Millions of households do and there aren't any rules about that.

The fence belongs to someone, you or them?

There are rules about smoke from bbq's and it blowing into neighbours property.I had a call from the police years ago after a neighbour complained
