Personally I wouldn't claim it. Someone else has picked the bait, chose the rig, selected the spot, and when the alarm goes and the fish hooks itself then by lifting up the rod, in my opinion to bring in an already hooked fish it would seem a very hollow victory indeed to somehow proclaim the rights to having caught that fish.
Nah, I couldn't claim any success for that and it would seem very wrong to do so imo - just my thoughts on it and I appreciate others might feel differently.

Reminds me of a time when anglers either side of me were both attached to the same carp. They were yelling at each other to slacken off but neither would give way. The fish surfaced in front of me so I landed it. The poor fish was wrapped in line but not hooked by the time it was on my mat. The silly burgers kept up a argument over who had caught it; I got sick of it and went home in the end.

Why have we broke the club rules ? As long as there is a member fishing in the swim there is no rules broken. I could look after my brothers rods for an hour. Then go 2 swims up and do the same thing if needed. I have checked with a bailiff in the past. And he said its fine as long as I've got my membership with me. As his dad has looked after his rods while he has had to go of the complex.

I can see why this is contentious, and say why it shouldn't be allowed. It's rpart of the law on your rod license. You're allowed to fish two or three rods no more than ten feet butt to butt. You must also be in control of all rods in the water. So yeah, technically it's illegal.
Imagine you get takes on your rod and a rod in the next swim. You cannot strike and play both, so one leaves a fish tethered, and potentially in danger. I imagine that what the law is there for. Any bailiff worth their salt should know that too.

I'd respoectfully disagree. While his brother was away, technically he was. I'm sure if you leave your swim you should reel in, or is fish safety no longer our priority? How do you think the EA would view it?

Simple answer, you leave the swim, you reel your rods in.
You may be a club member, but you only needed to look after the gear for the time he was gone, even if it is on the bank, not cast in. Your brother or mate whatever, technically left his gear in the water when he left the fishery, he did not catch the fish.
It is not your fish, you did nothing to deserve it.
If club rules state that when you leave the water you take your gear with you, between you you have effectively stopped someone else fishing that swim or peg.
It reeks of the swim hogging, bucket placing to reserve a swim, only because the gear was left in deserves a punishment of being shot every day at dawn for the next 6 months until you learn you shouldn't do it.

The impression I got was that he wasn't fishing at all and popped down to mind his brother in laws rods.
If as you say, he was minding both his rods and his brothers at the same time then I agree with you, but that hasn't been said once by the OP
